Terms of Service

TrailBlaze Utah ("TrailBlaze," "we," "us") runs trailblazeutah.com, a directory of Utah businesses, and TrailBlaze AI, a service that answers calls, texts and messages for local businesses. Our mailing address is PO Box 344, Goshen, UT 84633, and you can reach us at [email protected].

By using the website or our services you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use them. These Terms apply to visitors, people who contact a business through us, business owners who claim a listing, and businesses that use TrailBlaze AI or other paid services.

Use TrailBlaze only for lawful purposes. Don't misuse forms, send spam, post false or misleading information, impersonate a business or person, try to get into accounts or systems you're not authorized to use, scrape or copy the site in bulk, or interfere with how it works.

You must be at least 18 to create an account, claim a listing or buy a service.

Listings show business facts such as name, address, phone number, hours, website, category and Google rating. For listings the owner hasn't claimed, this information comes from public sources and third-party data providers, and the page says the owner hasn't confirmed it yet. Unclaimed listings show a stock photo for their category, not the business's own photos.

We work to keep listings accurate. Short descriptions on unclaimed listings are drafted with AI from the business's own website or Google profile and fact-checked against that source before they're shown. Even so, listing information is provided "as is" for general information, and we can't promise it is complete or current. Check important details (hours, prices, licenses) with the business directly.

Every listing has "Fix it free," "Report wrong info" and "Remove this listing" options. If you own or manage a business and want its listing corrected or removed, use those options or email us. When we remove a listing at the owner's request, we don't add it back.

We may create, edit, organize, merge or remove listings to keep the directory accurate and useful.

The TrailBlaze Score and our rankings, "Top Rated" badges and "Best of" pages are our opinion, based on public information such as Google ratings and reviews, how complete and consistent a business's information is, and its website. How the score works is explained on our Methodology page.

Paying us never changes a business's score or rank. A business can pay for a Sponsored placement, which is advertising: it is always shown in a separate box labeled "Sponsored," apart from the ranked list.

Only the business owner or someone authorized by the business may claim its listing. We verify claims, for example with a code sent to the business's listed phone number. If a claim isn't verified within 14 days, we may release it.

Once you claim a listing you're responsible for the information, photos and offers you add. You confirm you have the right to use them and that they are accurate and lawful. We may remove anything that isn't, and we may remove a claim made by someone who isn't authorized.

Reviews must be your own honest experience with the business. Don't review your own business or a competitor, don't post reviews you were paid or rewarded for without saying so, and don't post anything false, hateful, threatening, or anyone's private information. We may hold, remove or decline content that breaks these rules, but we don't remove reviews just because they are negative.

When you submit content (reviews, photos, business details, messages), you keep ownership of it and give TrailBlaze a non-exclusive, royalty-free license to host, display and adapt it to run the website and our services. You confirm you have the right to grant that license.

When you send a request, claim a deal or ask to be matched with a business, we pass your name, contact details and message to that business so it can reply. For a business that has claimed and verified its listing, we send it right away. For a business that hasn't, we only tell the business that someone asked, and we share your details after the owner has claimed and verified the listing. For a faster answer you can always contact the business directly.

The business, not TrailBlaze, is responsible for its reply, its prices and the work it does for you. We are not a party to any agreement between you and a business.

TrailBlaze AI answers a business's missed calls, website chats and forms, books jobs, and (on paid plans) texts the business's customers, sends pay links and review requests, and runs other marketing the plan includes. Plans, prices and what each includes are on our Pricing page. Every business can start with a 30-day free preview; no card is needed for it, and it ends unless you choose a plan.

If you sign a separate agreement or order with us for TrailBlaze AI or another service, that agreement controls where it differs from these Terms.

If you use TrailBlaze AI, you are responsible for: (1) having your customers' permission to contact them by text or phone, including the written consent the law requires for marketing texts, and honoring opt-outs; (2) the accuracy of the information, prices and services you give us to share with customers; (3) any notice your customers must get, such as that they are talking with an automated assistant or that calls may be recorded or transcribed, if those features are turned on; and (4) completing the carrier (A2P 10DLC) registration texting requires.

The AI assistant can make mistakes, misunderstand a caller, or be unavailable. It is not an emergency service. Review your messages and bookings, and make sure customers with emergencies can reach a person.

Paid plans are billed in advance, monthly or yearly, through our payment processor (Stripe), and renew automatically until you cancel. You can cancel any time from your account or by contacting us; cancelling stops future charges, and you keep access until the end of the period you've paid for.

We don't give cash refunds, including for partial months or the unused part of a yearly plan. Instead, our guarantee: if TrailBlaze AI catches fewer than 5 contacts for you in a paid month, as counted in your dashboard, your next month is free. Money you spend directly with ad platforms (for example Google or Meta) is paid to them, not us, and isn't refundable by us.

Payments made before October 28, 2026 keep the 30-day money-back refund that was in place when you bought.

We may change our prices. We'll tell existing customers at least 30 days before a change affects them, and you can cancel before it does.

If you give us your mobile number and agree to receive texts (for example when you start TrailBlaze AI or claim a deal), we may text you about your account, your requests and, where you agreed to it, offers. Message frequency varies. Message and data rates may apply. Reply STOP to stop at any time or HELP for help. TrailBlaze AI's account texts (your morning brief, end-of-day wrap and alerts) are part of the service; agreeing to marketing texts is never a condition of buying anything.

We don't send marketing texts to businesses or people who haven't agreed to receive them.

TrailBlaze links to and works with other services, such as Google, maps, booking and payment tools, and businesses' own websites. We aren't responsible for their content, accuracy or practices, and your use of them is under their terms.

Apart from the guarantee described above, we don't guarantee rankings, traffic, calls, leads, bookings, reviews or revenue. Any examples of results are illustrations; yours will depend on your business, your market and other factors.

The TrailBlaze website, name, logos, design, software, TrailBlaze Score and our original text are owned by TrailBlaze Utah or used with permission. Don't copy or redistribute them without our written permission.

Business names, logos and trademarks shown in listings belong to their owners. Showing them doesn't mean the business endorses TrailBlaze or that we endorse the business.

Some content on TrailBlaze, including some listing descriptions, city and category pages, blog posts and our chat and phone assistants, is created or drafted with AI tools. Listing copy is fact-checked against the business's own website or Google profile, but AI can still make mistakes. Owners who claim their listing control its description, and anyone can report an error.

If you're a paying client and a deliverable we make for you uses AI, we'll tell you which parts on request. Purely AI-generated material may not be protected by copyright, which can affect your ability to claim exclusive ownership of it.

We respect copyright. If you believe something on TrailBlaze infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to our Copyright Agent with: (1) your physical or electronic signature; (2) the copyrighted work you believe is infringed; (3) the material and where it is on our site (for example the page URL); (4) your name, address, phone number and email; (5) a statement that you believe in good faith the use isn't authorized; and (6) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

Copyright Agent: TrailBlaze Utah, PO Box 344, Goshen, UT 84633, [email protected]. We'll respond to valid notices and remove or disable the material where appropriate. If your content is removed, you may send a counter-notice under the same law, and we'll forward valid counter-notices to the person who complained. We may close the accounts of repeat infringers.

TrailBlaze and our services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't promise the site or services will be uninterrupted, error-free or always accurate.

To the fullest extent the law allows, TrailBlaze Utah and its owners, contractors and service providers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, customers or data, arising from your use of the website or our services.

To the fullest extent the law allows, our total liability for any claim relating to the website or our services is limited to the greater of $100 or the amount you paid us in the 12 months before the claim arose.

If you are a business using our services, you agree to defend and cover TrailBlaze Utah against claims, fines and costs (including reasonable attorney's fees) arising from content or information you provide, your messages to your customers, your lack of required consent, or your breaking these Terms or the law.

We may suspend or end access to the website, a listing, an account or a service if it is being misused, is inaccurate or fraudulent, puts others at risk, or breaks these Terms or the law. You may stop using TrailBlaze at any time.

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute not resolved under the next section will be brought only in the state or federal courts located in Utah, and you consent to their jurisdiction.

If you have a problem, please contact us first so we can try to fix it informally. If we can't, either of us may bring an individual claim in the courts named above, or in small claims court if it qualifies. To the extent the law allows, claims will be brought individually and not as part of a class, consolidated or representative action.

If any part of these Terms is found unenforceable, it will be limited or removed only as much as needed, and the rest stays in effect.

We may update these Terms. We'll post the new version here with a new "Last updated" date, and for changes that matter to paying customers we'll also tell you by email before they take effect. Using TrailBlaze after a change takes effect means you accept the updated Terms.
